AI Detective respects the intellectual property rights of others and expects users of our Services to do the same. This policy outlines our procedures for responding to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512) ("DMCA").

1. Reporting Copyright Infringement

If you believe that content available on or through AI Detective Services infringes your copyright, you may submit a DMCA takedown notice to our designated agent.

1.1 Required Information

Your notice must include the following information:

  1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notification, provide a representative list.
  2. Identification of the infringing material: The specific location (URL) of the material you claim is infringing, with enough detail for us to locate it.
  3. Your contact information: Your name, address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.
  6. Signature: Your physical or electronic signature.

1.3 Sample DMCA Notice Format

2. Our Response to Valid Notices

Upon receiving a valid DMCA notice, AI Detective will:

  1. Remove or disable access to the allegedly infringing material
  2. Notify the user who posted the content that it has been removed
  3. Provide the user with a copy of the takedown notice (with personal information redacted)
  4. Inform the user of their right to submit a counter-notification

3. Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification.

3.1 Required Information

Your counter-notification must include:

  1. Identification of removed material: The specific material that was removed and its location before removal.
  2. Statement under penalty of perjury: A statement that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the federal district court for your address (or any judicial district in which AI Detective may be found if you are outside the United States).
  4. Agreement to accept service: A statement that you will accept service of process from the person who submitted the original DMCA notice or their agent.
  5. Your contact information: Name, address, telephone number, and email address.
  6. Signature: Your physical or electronic signature.

3.2 Counter-Notification Process

Upon receiving a valid counter-notification, AI Detective will:

  1. Forward the counter-notification to the original complainant
  2. Inform them that the removed material will be restored in 10-14 business days
  3. Restore the material unless the complainant files a court action seeking to restrain the user

4. Repeat Infringer Policy

AI Detective will terminate the accounts of users who are repeat infringers. We consider a user to be a repeat infringer if:

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents:

may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, the copyright owner, or AI Detective.

Before submitting a notice or counter-notification, please consult with a legal professional if you are unsure whether material infringes your copyright or whether it was removed by mistake.

6. Modifications to This Policy

AI Detective reserves the right to modify this DMCA Policy at any time. Changes will be effective upon posting the updated policy with a new "Last Updated" date.
